FAS aims to combat “fake” winners in public procurement
The Federal Antimonopoly Service (FAS) of Russia plans to strengthen control in the field of public procurement by obtaining the right to enter companies that won tenders by providing false information into the Register of Unscrupulous Suppliers (RNP). Maxim Shaskolsky, Head of the Federal Antimonopoly Service, told about this at the All-Russian Conference in the field of procurement.
According to him, work on new measures is underway at the government level, where the FAS is tasked with developing a unified approach to determining and verifying the reliability of data submitted in applications. In cases where the information turns out to be fake, the FAS intends to impose sanctions, including listing companies in the RNP.
Such unfair actions most often relate to construction. Alexey Lavrov, Deputy Minister of Finance, noted that in order to counter violations, a draft resolution has been prepared, which assumes the exclusion of the experience of individual housing construction (IHS) from the calculation of qualifications in applications. This is due to the fact that up to 90% of violations occur precisely when submitting unreliable data on housing and communal services.
Earlier, in the spring of 2024, Olga Gorbacheva, head of the FAS Department for control over public procurement, reported that a third of violations in public procurement are related to the stage of consideration of applications, especially in the construction sector. Many contractors involved in housing and communal services provide false data to increase the chances of winning, which leads to significant distortions.
Deputy Finance Minister Alexei Lavrov, however, pointed out that stricter requirements for procurement participants could reduce competition in a market where, on average, less than 2.5 applications per tender.
